Oregon’s ADU conversation has moved from “are ADUs allowed?” to a more expensive question:
Which rules will this specific ADU be reviewed under when the application is actually filed?
That question matters more now because Oregon’s next Residential Specialty Code cycle is already moving.

The Oregon Building Codes Division says the 2026 Oregon Residential Specialty Code is anticipated for adoption on October 1, 2026 and is based on the 2024 International Residential Code, existing Oregon amendments, and public code amendment proposals.
The risk is not that every ADU changes overnight. The risk is that a plan that looks feasible today may need a second look once code timing, energy/mechanical rules, local procedures, and fees are applied.
This issue is not a prediction that Oregon ADU setbacks, heights, lot coverage, or fees have changed statewide. The state has not published a simple 2026 ADU impact matrix for every city and county. Treat those details as local verification items.

Are there local amendments, overlays, design standards, or siting rules that matter more than the statewide headline?
Do energy or mechanical provisions affect equipment, envelope design, documentation, or cost?
The expensive mistake is assuming “ADU allowed” means the design package, budget, and timeline are already stable.
What is confirmed: the 2026 ORSC process is underway
BCD’s 2026 ORSC adoption page says the Residential and Manufactured Structures Board has started the adoption process for the 2026 Oregon Residential Specialty Code. The page lists an anticipated adoption date of October 1, 2026.
BCD says the 2026 ORSC process is based on the 2024 IRC, existing Oregon amendments, and public code amendment proposals. Review materials are already public, including structural, fire/life-safety, mechanical, energy, and heat-pump materials.
That gives Oregon property professionals a real planning signal: 2026 is not just a future label.
The adopted-codes page is also worth bookmarking because it shows effective dates, mandatory dates, errata, interim amendments, and program-page updates. Code timing is not always a one-day switch.
Practical move: before relying on a bid, feasibility memo, or purchase narrative, ask the permit counter which code edition and local rules will govern the application date you expect to use.

What may matter most for ADUs: energy and mechanical details
The clearest 2026 signal in the available BCD materials is not a statewide ADU setback rule. It is the energy/mechanical side of the residential code process.
BCD’s first-stage heat-pump provisions summary describes proposed 2026 ORSC Chapter 11 language related to first-stage heat-pump operation where split-system air conditioning is installed in new dwellings. In plain language, when a new home uses split-system cooling under the prescriptive compliance path, the outdoor condensing unit and indoor evaporator coil must provide heat-pump operation for both cooling and first-stage heating, unless an exception or alternate compliance path applies.
The same BCD summary also limits the claim: it does not dictate heating fuel, does not apply to replacement cooling systems, does not require resizing cooling capacity, and includes alternate compliance pathways.
Why this matters for ADUs: small units are sensitive to equipment choices, envelope details, utility capacity, panel capacity, mechanical space, and all-in cost. Technical compliance can matter even if zoning is unchanged.
Practical move: ask whether the planned ADU is treated as a new dwelling for the relevant provision, what compliance path is being used, and whether the mechanical design still fits the budget and space constraints.
What not to overclaim yet
Do not turn a code transition into a rumor mill.
At this stage, avoid stating any of these as confirmed statewide facts unless a local code page, ordinance, plan reviewer, or BCD document says so for the specific project:
ADU setbacks changed.
ADU height limits changed.
Lot coverage changed.
Yamhill County adopted on a specific local date.
Fees increased by a specific amount.
Any of those may be true in a specific jurisdiction. They may also be unchanged, delayed, locally amended, or irrelevant to the ADU type being proposed.
The right framing is: verify whether they changed for the property and application date you care about, especially in smaller cities, county jurisdictions, and rural-edge properties.
What stays in the feasibility stack
The 2026 ORSC process does not erase the basic ADU feasibility questions from Issue 002.
You still need to verify jurisdiction, zoning, ADU type, setbacks, height, lot coverage, overlays, sewer or septic feasibility, utilities, access, fees, permit path, timeline, and intended use.
The 2026 code transition simply adds another layer: technical compliance and timing may affect whether the plan you have is still the plan you should file.
Practical move: keep two checklists — one for land use/site feasibility, and one for code-cycle/technical compliance.
The jurisdiction reality check
Do not rely on a statewide headline when a local permit desk will review the application.
Ask your city or county:
Which residential code edition applies today?
What application date controls the code edition: submittal date, completeness date, plan-review date, or permit issuance date?
Is a phase-in option available, and what must be documented to use it?
Have local ADU siting standards changed, or are changes pending?
Are fees, SDCs, utility charges, or review procedures changing, if any?
For septic properties, has county environmental health or the local onsite program confirmed capacity and documentation requirements?
Where is the local code calendar posted?
That last question can change the sequence. A pre-transition filing may require complete drawings, energy documentation, utility information, and septic or sewer answers sooner than expected.
Practical move: write down the name, date, and department of anyone who confirms the applicable code path.
Cost and timeline: use ranges carefully
A code transition can affect cost through equipment selection, envelope details, energy modeling, documentation, plan revisions, utility work, and review time. But the delta is site-specific.
The useful question is not:
“How much will 2026 add to every ADU?”
The useful question is:
Which parts of my ADU budget are exposed to the code-cycle transition?
Look first at mechanical equipment, envelope details, windows and doors, electrical capacity, energy documentation, plan-review resubmittals, local fees or SDCs if any, septic/sewer documentation, and revision contingency.
If a builder or designer gives a range, treat it as a project estimate, not a statewide fact.

The 10 checks to run before you rely on an Oregon ADU plan in 2026
Confirm the property’s jurisdiction, zoning, overlays, and ADU path.
Confirm the residential code edition that applies to the likely application date.
Ask whether a phase-in period or local transition rule affects the project.
Identify the exact ADU type and whether it is treated as new dwelling construction, an addition, an alteration, or another category for code purposes.
Re-check setbacks, height, lot coverage, separation, parking, and design standards locally; do not assume they changed or stayed the same statewide.
Ask how 2026 energy and mechanical provisions may affect equipment, envelope, modeling, or documentation.
Confirm sewer or septic feasibility and whether an ADU changes bedroom-count or wastewater assumptions.
Check water, power, stormwater, fire access, driveway, and frontage requirements.
Ask about fees, SDCs, utility charges, and plan-review timelines, if any changes are pending.
Get key assumptions confirmed in writing before relying on rent, resale, appraisal, purchase price, or construction budget.
If you cannot answer these yet, that does not mean the ADU is dead. It means the feasibility file is unfinished.
Practical takeaway
The opportunity is still real. Oregon still needs more housing options, and ADUs remain one of the most practical small-scale housing tools available to owners, families, builders, and infill investors.
But the 2026 code transition is a reminder that feasibility is not static.
